Our goal is to empower landowners across Alberta by providing expert representation, advocacy, and support in navigating the challenges of surface rights matters and to ensure their property rights are protected and respected.
We are dedicated to championing the property rights of landowners throughout Alberta. With a steadfast commitment to integrity and professionalism, we specialize in providing expert representation services to landowners who are navigating an array of surface rights matters. Our professional approach and experience is highly respected by governing entities such as the Land and Property Rights Tribunal (LPRT) and the Alberta Utilities Commission (AUC).
For over 15 years, My Landman Group Inc has been helping landowners to successfully deal with companies that want access to their lands for the development of energy projects and installations.
1) Landowners who do not have copies of their Surface Lease Agreements should contact all active operators immediately and ask them for copies of these lease agreements. Contact us for more information.
2) Never deny an operator or the Orphan Well Association access to a surface lease on your land. If you do, this is grounds for the LPRT to deny rental payment to you. Call us for more information.
3) Operators CANNOT reduce the rent on your surface leases unilaterally. If they do, contact us to discuss what you need to do.
We represent landowners in negotiations with oil and gas and electrical transmission companies that wish to develop well sites, pipelines or power transmission lines on their lands. Our goal is to secure fair compensation for the landowner and to ensure the agreement terms and conditions protect landowner rights as well as the land.
Learn MoreIf an energy company applies to the Land and Property Rights Tribunal (LPRT) for a Right of Entry Order for a new well, pipeline or transmission line, we work to ensure landowners, via the Compensation Order negotiations or Hearing process, receive fair compensation for the "taking" and that the proper conditions are placed on the company's activities by the LPRT in order to minimize disruption to the landowner.
Learn MoreWe have a high degree of success when representing landowners in Hearing Proceedings in front of the Land and Property Rights Tribunal. This includes Hearings for 5 Year Rent Reviews for Surface Leases (under Section 27 of the Surface Rights Act), Hearings for Damage Claims( under Section 30 of the Surface Rights Act) and Hearings under Section 29 of the Surface Rights Act for the Reconsideration of incorrect Land and Property Rights Tribunal decisions (for example, when the LPRT has illegally reduced the amount of rental arrears it will tell the Government of Alberta to pay a landowner for a Recovery of Rental application).
Learn MoreThese projects are governed by the Alberta Utilities Commission. If you are agreeable to having the project on your land, we negotiate the highest compensation and ensure the agreements proposed to you are edited so that your rights are better protected. If a project is proposed near your land and you have objections to it being built in the proposed location, we represent you and like-minded neighbours to fight against its approval. Daryl Bennett of My Landman Group has extensive experience representing landowners who are faced with the complexities of these projects.
Learn MoreWe specialize in recovering rental payments owed by defunct oil and gas operators or by companies that have unilaterally reduced the rent for a surface lease on your land without your agreement. We do this through applications for Recovery of Rental under Section 36 of the Surface Rights Act. Many landowners are unaware the Alberta Surface Rights Act provides this protection for them. These applications can encounter challenges that we have the experience to deal with to ensure the landowners are paid by the Government of Alberta for all the rent that is in arrears and owed to them. This legislation provides much better protection for landowners than does the Receivership or Bankruptcy legislation and proceedings.
We have helped landowners with thousands of successful applications for Recovery of Rental and our fees are much lower than those of a legal firm. A lawyer is not required for these applications and proceedings. In addition, we can deal with any decision in which the Tribunal directed the Government of Alberta to pay less than the true rental amount owed to a landowner. We have recovered all such shortfalls for our landowners by making an application under Section 29 of the Surface Rights Act to have the LPRT Reconsider its original decision.
Learn MoreWe help landowners recover costs they must incur while dealing with energy companies, the Land and Property Rights Tribunal or the Alberta Utilities Commission. From rent review negotiations with an energy company to Hearing Proceedings, we ensure you are reimbursed as much as possible for the costs you incur while trying to protect your property rights.
